Wir erreichen die Co-Leiterin des Projekts, Anna-Mira Brandau, am Telefon. DIE ZEIT: Frau Brandau, haben Sie mit Ihrer Ausarbeitung autoritären Politikern ein Handbuch zur Verfügung gestellt, wie sie bei einer möglichen Machtübernahme die Justiz schwächen können? Anna-Mira Brandau: Nein. Ich vergleiche das gern mit IT-Sicherheit: Schwachstellen muss man kennen, um sie schließen zu können. Das gilt auch für das Recht. Wir haben systematisch Verwundbarkeiten im Justizsystem beschrieben. Es ist besser, dass Demokratinnen und Demokraten diese kennen und sich vorbereiten, als dass sie im Dunkeln bleiben.

Although only the continuous use of such mechanisms has a positive impact on trust, irregular or declining use is not equal to no adoption at all. Social-participation may remain activatable in the future under different court compositions or in new political contexts.

We show that the implementation of these mechanisms requires both the presence of a court composition that values openness (ideational factors) and the contextual incentives to use them (politicization and lack of trust).

We examine under what conditions Latin American high courts implement mechanisms of social participation in judicial decision-making and assess this with an expert survey in ten countries as well as three case studies (Argentina, Ecuador, Uruguay).
