The continuing uncertainty surrounding the definition of ‘sex’ in the Equality Act must ultimately be resolved through the legislative process – not through the courts.

Parliament must act to make it clear that trans women are women and trans men are men.

The government must urgently reform the UK’s workplace regulations so that employers do not to have to create, at great expense, segregated ‘third spaces’ that risk outing their trans employees.

Concerningly, employers will be required to provide facilities for their employees on the basis of so-called ‘biological sex’. This creates the perverse outcome that trans people will be able to use public toilets corresponding to their true gender in all contexts *apart from* in their workplace.

This means the EHRC’s draft Code of Practice does not accurately reflect the law. Bridget Phillipson must now send it back to the EHRC to be rewritten reflecting the trans-inclusive elements of today’s judgement.

Contrary to the position set out by the EHRC, service providers may allow trans women to use women’s facilities without being forced to open them to cis men. It will likely be unlawful to demand that trans people use services corresponding to their sex as recorded at birth.

Labour for Trans Rights welcomes the High Court’s decision that service providers may continue to operate toilet and changing room facilities on a trans-inclusionary basis.

But we need to keep up the pressure to make sure including trans people is the default.

The Guardian is reporting that EHRC is looking again at its proposed code of practice for single-sex spaces.
