I have shown in this paper how OSS advocates framed this dependency as a
problem and the promotion of OSS and open standards as the solution. I have also argued that the success of their efforts, specifically the promotion of OSS and open standards in the first EIF, brought Big Tech lobbyists to the scene. These lobbyists spread fear, uncertainty, and doubt about OSS among their existing connections in Brussels and influenced the EU’s OSS policies by infiltrating expert groups responsible for formulating the EU’s future open-source strategies. American incumbent firms were also helped by the fact that European SEP holders became involved in the discussions about the definition of open standards in the second version of the EIF, advocating for the proprietary incumbents. In the second version of the EIF, the EU significantly weakened the provisions promoting OSS and open standards.
“This article contributes to our understanding of the dynamic interplay between #OpenSource advocacy and the influence of proprietary incumbent companies on EU policymaking. This is important because history is repeating itself with open-source #AI in Brussels.”
