Good point re capability - I agree with you that at some point this happens (if it's possible to build things as smart as/smarter than people) but it seems like there will be a transition era where we could have the machine welfare part.
It seems more likely than not that at some point in the future there will be 'machine welfare' specialists and frameworks, akin to 'animal welfare' today.
