The law SHOULD be changed for one category of commercial property: Low Income Housing Tax Credit funded housing. In TN the tax credits provided to fund the housing for low income persons is TAXED as part of NOI. That is like taxing Section 8 vouchers as income. (Yes represent LIHTC developers.)
Income value (NOI x cap rate) is already one of the 3 methods used to appraise commercial properties. Check the case law. So the only thing they really want is to be moved to the front of the line.
1) grace period during appeal; 2) expedited appeals for them; and 3) use of property income to determine value. 1 and 3 are ALREADY the law. An owner must pay prop taxes before they can appeal. BUT by law you can pay a "good faith estimate" instead of the amount determined by the assessor.
