In our submission (p.4-9), we highlight our real concerns with the Government’s decision to copy and paste the definition of ‘sex’ from the Supreme Court ruling into Scottish law. The Cabinet Secretary for Justice has responded (p.17-19). But we still aren’t persuaded the Govt. has got this right.
Engender’s submission (p.10-16) highlights why they think adding ‘sex’ to hate crime law is the wrong approach & won't protect women & girls from harm. In fact, they think it could make things worse, by undermining a gendered approach to the law that recognises the sexism & misogyny women face.

On Friday the Criminal Justice Committee published the papers for their meeting this Wed – when Committee Members will get to ask Scot Gov about their proposals to add ‘sex’ to hate crime law.

In increasingly challenging times of political and social struggle, it can feel hard to imagine a way through. While the LGBTQIA+ community has a long history of activism and resistance, many struggle to connect to it and understand how our past can shape our actions today.

One of the most positive parts of the judgment was that it said that it remains lawful to provide trans inclusive services and facilities. This was totally missing from the draft Code of Practice consulted on by the EHRC in the summer.
