You know it is illegal. You know you'll almost certainly lose in court, if challenged. You do it anyway. If your hope is that you are not challenged in court, or that you'll happen to find a sympathetic judge to uphold your illegality, it doesn't change the fact that you KNOW what you do is illegal.
At some point it becomes clear that this is intentional illegality.
Every lawyer involved in defending this in court should lose their license and never practice law again. Every agent, officer, or leader in the DHS directing this policy should end up behind bars.
