The answer is due process.

It's just very very hard to litigate against a party that is not acting in good faith and doesn't care about the penalties the courts have to offer.

Folks impacted by immigration courts have been telling folks for YEARS that these “courts” provide everything but justice. The whole system is rotten from the inside out this is just the most recent example.
