Graham statement on Noem/Mullin
"I think it was time for a change"
🚨 I asked the WH if Mullin will be acting DHS secretary and/or the nominee to be Senate confirmed
A WH official just told me: "The White House will work to confirm him as quickly as possible"
I just asked Rep. Lisa McClain (GOP conference chair) what, if anything, GOPs could find a middle ground on with Dems for DHS negotiations
She said “not much”
Durbin statement on this DOJ proposed rule
Appearing before the House Judiciary Cmt, Noem just claimed of the 400,000 instances where DHS detained someone under an administrative warrant, just 28 of those have been used to go into a home
A new proposed DOJ reg would allow the department to review allegations made against its current/former attorneys in state bar complaints before they participate in investigations 👀

Schumer just said at his briefing on DHS, the two sides are “still far apart, but we’re still negotiating and exchanging paper back and forth.”
Britt just told me DHS negotiations resumed on a "member level" over the weekend and she's feeling hopeful.
"I think people understand how critically important that is and in particular with increased threats to the interior, as we saw in Austin.”

The tl;dr is that Dems are skeptical that this role will be free of WH influence

Following concerns about WH influence on the new DOJ role for fraud, Grassley says the org chart shows the "traditional chain of command" within DOJ

After 9hrs at home, back on the hill to cover the hearing for Colin McDonald, the nominee for the new assistant AG role for fraud.
Curious if Dems will ask about Trump's statement last night that Vance will oversee this effort

Trump says the "war on fraud" will be led by Vance
The WH already announced a new assistant AG for fraud and new division at DOJ
The nominee Colin McDonald has his confirmation hearing tomorrow morning
Re: tariff decision Trump just said “The Supreme Court’s unfortunate involvement” with four justices sitting right in front of him. They didn't appear to have any physical reaction
Trump has entered the chamber
RIP to the "bedtime approaching" notification I just got from my Oura ring
Greetings from inside the chamber.
Justices Roberts, Kagan, Kavanaugh and Barrett just entered.
Will be interesting if Trump greets them and/or addresses them during the speech after railing about the court post-tariff ruling

GSA pushed back on the judiciary's allegations

Britt (lead GOP negotiator on DHS) tells reporters she expects Trump to address DHS funding during the SOTU
When asked where negotiations stand she said we’ll have to listen to what Trump says tonight
I asked Schumer if his assertion he won't negotiate publicly on DHS will change if Trump brings it up tonight. He said it depends. "So far they have not budged on key issues" like masks, warrants and states' oversight. "They're not negotiating; they're just trying to pass paper back and forth"
During a Dems presser pre-butting SOTU, Klobuchar says she didn’t think she’d have the “hottest ticket in town” sitting behind the Supreme Court justices tonight

Seven months after the budget reconciliation bill was enacted, the federal judiciary is making progress on the provisions to rein in what Republicans deem abuse of nationwide injunctions targeting the Trump administration's initiatives. www.law360.com/artic...
Graphic by @benjayingly.com using data from the tracker Habeas Dockets
Karen Mitchell, clerk of court for the NDTX, said, "The number of civil immigration-related cases, which are mostly habeas, has increased from around 170 a year to more than 300 last year...We will be happy when the judicial vacancies have been filled"
I spoke with Judge Fred Biery of WDTX (who ordered the release of a 5 y/o Liam Conejo Ramos and his dad). "Up until all of these habeas cases we were able to keep up," he said. His division doesn't have vacancies , but "what would help us is if there were new judgeships created"
It's Friday evening and tariff opinion today, so this is probably going to get overshadowed, but a feature I wrote on the impact of the persistent vacancies on the Texas federal courts on the influx of deportation cases just published 🧵
