it's true that MQD is malleable enough that it can mean whatever they want it to at this point, but i don't think that paragraph is actually articulating an MQD argument.
it's just a statutory construction argument based on expressio unius.

yeah I was about to say. the CEI data is based on basic searches using tags in the Federal Register, which is a flawed way to quantify actual rulemaking activity. (Lots of things are tagged as both a notice and rule, some IFRs/DFRs are tagged as proposed rules, etc.)
