7.10.2023, the longest day in
History. Canโt wait for it to be over.
Passing time, waiting, counting minutes. One thing I felt friends and colleagues abroad didnโt fully get was that as long as there were hostages in Gaza, October 7th was not in the past. Every single day, every single act were overshadowed by the guilt of the abandonment of our brothers and sister.
On the state of democracy in Israel, in French, this time
4. Not long ago, it was Israel who objected to the ICCโs jurisdiction in the situation of Palestine on the grounds, among other things, that recognition of a Palestinian state was contrary to the Oslo Accords which prohibited unilateral action and where still
in force, despite violations.
3. For those arguing that this has always been Israelโs position - there is a difference between a political position put forward within the context of future negotiations, and one that is used *now* as legal ground to justify unilateral actions.
2. And if the West Bank is now treated by Israel as part of its own territory, how does it explain that Palestinian residents of it do not have equal rights, including the right to vote and freedom of movement?
1. With all eyes on Gaza, this bizarre, to say the least, statement by the Netanyahu government passed under the radar. If Israelโs position is now that the West Bank is de Jure part of Israel, what does this is imply for the legal framework of the law of occupation which Isreal itself applies?
Stop this war, bring them back
In the midst of everything going on, glad to have had the opportunity to present my work on solidarity and constitutionalism, and advocate the notion of solidarity as one that can do actual work in the constitutional field, with regards to both constitutional design and interpretation.
We are launching an LL.M. program in Comparative and Global Law @uni-muenster.de, which is one if the top places in Germany to study law in English, w particular strengths in comparative law & legal history.More info below, pls help spread the word! www.jura.uni-muenster.de/de/internati...

Published! - What is the role of legal scholars when populism
and democratic erosion are on the rise? Some lessons from the Israeli experience. With @yanivroznai.bsky.social @eliavl.bsky.social @adamshinar.bsky.social and Ittai Bar-Simam-Tov academic.oup.com/icon/article...
Seal the deal, bring them home
Our article about the role of legal scholars in counter-populism is now available at ICON. It might have some takeaways for the US now.
Bottom line: legal scholars are uniquely positioned to expose untruths about law/institutions, which often form the core of the populist argument.

Bring them home, end the war
Many thanks to the @ccds-aup.bsky.social for a fantastic conference on โRenewing the Social Contractโ, and for the opportunity to present my paper titled: โIs solidarity necessary for democracy? (and if so, what should constitutional law do about it?)โ, part of my ongoing project on solidarity
Comparative constitutional
Law questions: for my ongoing project on solidarity and constitutionalism, looking for case law that applies, refers to or interprets the notions of solidarity/fraternity. Any references will be much appreciated!
The future of fair elections in Israel - and of replacing this government - is under real threats. I interviewed for this very important piece that outlines the governmentโs plan to entrench its power www.shomrim.news/eng/the-legi...
Looking forward

2. It would be nice if the leaders of the *opposition*, which were quick to condemn the decision and call for โdiplomatic measuresโ against the Court, will at least not fall into this trap.
1. There are reasons to worry that the government of Israel will manipulate the situation to impose sanctions on anyone that โcooperates with the ICCโ, broadly defined, as means to suppress all criticism regarding the war and as a means to limit human right organizations.
