I agree. Prosecutors file 1st Degree Murder charges on much less, all the time in State Court.

But even if a jury wasn’t convinced of 1st, the lesser included of 2nd degree would be a done deal.

Problem is, prosecutors are chicken shit and only charge poor people. At least here in Oklahoma.
