These draft regulations amend the rules for certain benefits, requiring people moving from the rest of the UK to Scotland who receive a corresponding DWP benefit to submit a new application to Social Security Scotland.

The letter recommends, alongside these changes, that the Scottish Government identify more ways to offer information to people about financial support, including benefits like Universal Credit.

Reflecting decisions by the UK Government, the draft regulations seek to remove references to child tax credits and/or working tax credits from various devolved benefits to reflect reserved benefits which continue to provide a route to eligibility and child responsibility.
The draft Social Security (Best Start Grants, Best Start Foods, Funeral Support Payment, Scottish Child Payment and Winter Heating Payment) (Miscellaneous Amendment) (Scotland) Regulations 2025 have been received from the Scottish Government and we will now begin our scrutiny process.
