This one's like a Coen Brothers movie. A local prosecutor sent two henchmen (on the gov payroll) after his wife's opponent for school superintendent.

Though I am critical of Justice Gorsuch's approach, I feel a certain kinship. I write what I believe, without regard to what others might think. Indeed, as I noted recently, I write what I write mostly for myself. It matters little to me whether people respond to me, either positive or negative. Justice Gorsuch cares about these issues profoundly. He has given them a lot of thought. He is, as we often are, entirely convinced he is correct. Gorsuch also thinks that some of his colleagues are being inconsistent. Gorsuch rightly calls Justice Kagan out for flip-flopping (see Jason Willick's essay), and suggests that Justice Kavanaugh has not made his case. But in the end, Justice Gorsuch does not seem to persuade anyone else. I can relate.

Arresting people who call you a fascist is not, imho, the best way to beat the accusations.

Mayor Hansen immediately gaveled him down and warned Petersen not to “address the chief of police in that manner.” [ECF No. 27-4 at 53]. When Petersen reiterated his criticism, Mayor Hansen suspended the meeting and ordered him to leave the chambers. Id. As Petersen walked toward the exit in apparent compliance, Lieutenant Christopher Wing intercepted him at the door and arrested him for disorderly conduct. [ECF No. 27-2 at 630]. When Petersen protested that he was attempting to leave as directed, Wing placed him in handcuffs and served him with a 24-hour no-trespass order. [ECF No. 27-4 at 54]. "When pressed on why accusations against the rental inspector did not violate the Rule, [the mayor] offered shifting explanations: the speaker was a 'very good friend." .... "Most revealing is the mayor's own admission that praising the police department would, "of course" not violate the Rule.  Criticism was restricted; praise was welcomed."

After arresting Noah, the mayor told him to "go take his activism somewhere where someone cares." The criminal complaint charged Noah with "speaking negatively towards the Mayor and Police Chief." And the mayor admitted the rule didn't apply to people who praise the police.

That’s exactly right. Seeing McLaughlin and Bovino go actually worries me.

Even though the facts on the ground will be the same, it was a lot easier to get a judge to distinguish Perdomo when the Admin kept admitting they were applying the wrong standard. That’s what got the PI in Escobar Molina.

Been thinking a lot about how the risk in a case getting to the shadow docket now isn’t just that you lose the injunction but that only one or two justices muse about why, giving their view the imprimatur of the court for several years.

A lot of this Admin’s policies are an attempt to force the law to the right.

But plenty are so bad they won’t convince most conservative judges.

So the Admin is just taking advantage of all the bad SCOTUS decisions that make it hard to enforce the Constitution.
