I think it's funnier - especially in context - if there is no explanation as to why her shirt is suddenly ripped. Its just the rules of the genre.
The "Batman branding people" bit appears in several other Batman scripts from other writers that never saw the light of day. I assume its one of those "one producer is obsessed with the idea" things, like the mechanical spider that ended up in Wild Wild West. Also, its The Phantom's thing.
