Harper to the judge: "Your driver's license doesn't list your height and weight at birth. It doesn't list where you used to live. It identifies who you are now."
He's putting up record job losses, driving the country into a war he can't even explain, and was credibly accused of raping a teenager in the Epstein files released yesterday - so of course it's time to try and ruin more trans people's lives
The justices had ample opportunity to decide this issue the right way. Instead they sneaked in a slapdash ruling on the shadow docket. slate.trib.al/jHCHHvT

This happened on Monday night on the shadow docket. It proved my longer article's argument about using "constitutional opportunism" to attack LGBTQ rights (link in comments). Thank you, Mark @mjsdc.bsky.social, for amazing edits.
New study in Lancet eClinical Medicine (N=20,358) found that mental healthcare utilization initially increases (consistent with assessment requirements under guidelines), then drops substantially, following gender-affirming medical care. #transgender #mentalhealth #medicine
Congratulations! Did you know when we met at ALPE? This is fantastic.

I will not support a deal that does nothing to make health care more affordable.
We are in a health care emergency. A simple one-year extension of these tax credits would cost less than Donald Trump’s $40 billion bailout for Argentina.
A vote for this bill is a mistake.
@hilakeren.bsky.social analyses the US v Skrmetti case which marks a significant & devastating departure from the constitutional principle of equal protection.

I am very grateful for the invitation and publication by the Oxford Human Rights Hub. This is not normal and should not be normalized. ohrh.law.ox.ac.uk/deep-denial-...
This is a horrifying and alarming firing, yet more evidence, as I have written repeatedly, that the Washington Post no longer serves the community in its name.
My Bloomberg Law insight on how the administration censors California, trying to erase any mention of gender identity and trans students from sex education, and does so while emboldened by SCOTUS' recent decisions.

I am so sorry, but this is how bad it is, and writing about it as it happens is one way to resist, so I did (while citing @mjsdc.bsky.social). This is constitutional rights for me and not for thee! slate.com/news-and-pol...
Contrary to Trump’s grotesque, self-congratulatory press releases, he has not ended gender-affirming care for young people; rather, as the health care workers I spoke to this week made clear, hospital management, boards, and their legal advisers have ended it for him. My new story:
I included the movie as a form of resistance, which I propose against "Constitutional Opportunism" - the way SCOTUS (with help from NYT... as you show) intentionally attacks LGBTQ+ equality. Draft: papers.ssrn.com/sol3/papers....

1. State AGs have sued Trump for intimidating providers from providing trans care.
Meanwhile, institutions are dropping trans people left and right out of fear of Trump.
Suing Trump isn't enough. State AGs MUST enforce equality laws against cowardly orgs.

New baby paper submitted! Download it, please. "Constitutional Opportunism" tells how the Supreme Court takes an active part in the conservative attack on LGBTQ people. Hope student editors see the urgency because we have conversion therapy and participation in sports on the docket for next term.

Jake Sherman is reporting that the Medicaid gender affirming care ban has been removed from the reconciliation bill!
Huge news!
@samfeder.bsky.social So grateful for your amazing work. I wish I had the money to make the movie free for streaming everywhere (also: was with you in the elevator without realizing who you are).
With plenty of moving testimonials and charming talking heads, Heightened Scrutiny draws damning lines between the “just asking questions” opinion pieces published in respected mainstream media publications like The Atlantic and the New York Times and the legal arguments made in our judicial system. The damaging rhetoric in these outlets is directly and immediately echoed by lawyers, judges, and “experts” brought into court—and because of how clicky transphobic stories have historically been, this vicious cycle has recently ramped up. Add in the targeted bigotry of the increasingly radical right, and the legal, cultural, and medical fight for acceptance now waged by trans folks has gotten all the tougher as public awareness has grown.
Heightened Scrutiny, a very good doc about the Supreme Court case that was just ruled on, does an impeccable and infuriating job laying out just how culpable the NYT and Atlantic are for the nation’s transphobia www.avclub.com/sundance-202...

Last night, I was at a special screening of Heightened Scrutiny - a new documentary about @chasestrangio.bsky.social and the fight for access to gender-affirming care. I laughed, cried, got mad at the media, and was inspired to continue fighting. The movie is a MUST! and Chase Strangio is a hero.
I wrote about how US v Skrmetti is devastating and wrong, but there are two other ways in which bans on gender-affirming care are unconstitutional, which are still challenged in courts. news.bloomberglaw.com/privacy-and-...
