I’ll also add to your second point: while Donitz was acquitted for unrestricted submarine warfare, he was convicted for conspiracy to commit war crimes and crimes against humanity, and of initiating and sustaining an international war of aggression.
And as for the Laconia Order, recall that:
- the charges against Donitz were for attacking neutral shipping; a concern for not rescuing survivors of a warship wasn’t in question
- he was anyways acquitted for the third charge … attacking merchant shipping aiding a war effort is lawful.
So yes, it may offend you, but “all possible” in this case meant “not possible”. A belligerent is not required to give up its right to self defense. For a submarine, that means not surfacing and remaining undetectable.
Armed conflict is often cruel, but that doesn’t inherently make it unlawful.
I haven’t seen much detailed reporting, but it sounds like the Iranians themselves made a distress call and the Sri Lankans responded.
Also, the submarine was likely operating independently. If they were in fleet ops, they wouldn’t have engaged with a torpedo. There wouldn’t be a U.S. ship to call.

“Unarmed” wouldn’t render a warship exempt from attack. By its very functionality as a surface combatant, it is a valid target until and unless it surrenders or is given “safe conduct” by the belligerents.
