They cannot go to any lower court because they are 3p to the case that originated the (final) injunction which directly impacts them. They filed a motion for annulment because they believe they should have been a party to the case. Since it was denied, they are appealing to the Constitutional Court

I believe the situation in Spain is unprecedented. Overblocking has impacted a Royal Academy, government websites, media outlets, online platforms (X or GitHub), banks, blogs, payment gateways, residential home automation… Cloudflare and others filed an action before the Constitutional Court.

Sinceramente, no veo tan incompatible compartir los objetivos generales de la DSA con advertir, en un contexto muy diferente a un mero informe de transparencia, de posibles riesgos derivados de interpretaciones maximalistas de algunas obligaciones de diligencia debida.

I am not sure. The territorial scope of the remedy might be different depending on the cause of action. The platform may strategically elect to rely upon the DSA, which guarantees due process, a degree of transparency, or robust redress mechanisms for their users.

First AI fair use ruling, but probably of little predictive value for the big pending genAI cases, as it involved an AI developer that copied Westlaw headnotes to train a legal research model to directly compete with Westlaw (at least that's how the court describes it).
