I feel the same way. But I don't think a court of law will. I will say that according to what I saw in the video he can't really claim self defense when he made absolutely no movement to get out of the way of the vehicle. In that way he demonstrated *intent* to kill.
But they couldn't get 1st degree murder because they'd have to prove premeditation.
