War Crimes & Geneva convention - you know, the things that *actually* determine what is a war crime and what isn't - have nothing to do with US domestic law.
And as has been shown many times, domestically, the US president can conduct mil operations without a declaration of war.

At the time of the alleged offences, it would have been covered by the Official Secrets Act, and now the National Security Act: it's the passing of Government information to an outside party, or - you know - spying..
