Nope. Justice Alito's views on this one were baked in years ago.

All the NY order does in that respect is show that Alito's gonna Alito.

There are legit reasons to think the state trial court got this one wrong, so I can't get behind my normal suggestion.

But SCOTUS just (without explanation) stayed one particular order on one particular date. Nothing stops a trial judge on the receiving end of these from issuing another order.

This is absolutely right, and exhibit 17492 in why the Court's abuse of emergency stays is power rather than law.

Justice Alito is only writing for himself. The majority didn't bother to offer any explanation _at all_. We have no idea if they realize what he says is nonsense and just don't care.

The SCOTUS decision is trouble for all of Justice Sotomayor’s reasons.

But also the trial decision was trouble: you don’t usually get relief w/o proof that a new district helps fix the alleged problem.

My take has been that this has been SCOTUS bait (derogatory) from the start.

If this ruling is upheld, the speed of a SCOTUS pivot from Callais to this case will break the sound barrier.
