It has never ever been like that in the US, never. We have rape kits, but it's almost irrelevant here. We have some laws but they are NEVER followed, and when they are, the man just files a cross-complaint against her, she gets intimidated and it's over. South Am countries probably worse.

No, they are are charged when they are arrested, here. They may be detained for questioning, but that is not an "arrest," in the US. Charges may be dismissed at trial via motions between the lawyers, or by negotiation of the lawyers, which they then bring to a judge - who then may or may not agree
