GenAI Tools can be a blessing for creators - tools to help, but those tools cannot come at the cost of other creators losing the right to their content, likeness - that's not a technology conversation, that's a societal conversation. The technology can follow.
And with that, unclarity of data ownership is now mixed in. Things that should be absolutely clear are things like likeness, derivative works - but the ai fog of war made things muddy and unscrupulous actors took advantage of that. We need to return to a discussion about ownership&rights.
The notion of the distribution and indexing platforms using that data for commercial purposes was first approached in the early internet days - f.ex. the laws around hyperlinking. But that was when people had and "owned" websites - now your content goes to aggregation / distribution platforms.
The real question for the current wave of generative AI is pushing is control and ownership of data that has been "publicly" available. Now that is useful in creation, it is right to re-question the ownership of that data. We were all there when the big platforms (search, social, entertainment) came
