Plaintiffs may have consented so they could depose people after the government complies with it's written discovery obligations. But under seal, so got me.

And I'm absolutely blown away by everyone working at our local federal courts. The DDC & DMd court staff, judges, clerks, everyone, are putting in heroic hours. And I'm so sorry for anything I eff up filing that creates more work.

But deference in this context means that the Executive can choose how to act lawfully; it does not mean that the Executive can act unlawfully. For example, the Executive is entitled to a high level of deference in its management of military affairs.
