Nothing has been filed by DHS. The court is doing this on its own and I suspect motions to pretermit will follow (kind of like "tickling the wire" if you know what I mean). The cases remain in Seattle and the IJ hears them from L.A.
A bunch of my Somali clients who have pending asylum cases in immigration court in Seattle have been rescheduled to hearings in late February on an expedited basis with a judge who sits in Los Angeles who has a 99.6% denial rate as reported by Syracuse University. NPR reported on this today.
The trump admin has entered into Asylum Cooperative Agreements (ACAs) with Honduras, El Salvador, Guatemala, Ecuador, and Uganda in which these countries agree to accept deportees from the US even though they are not citizens of the "third" country. These are done pursuant to motions to pretermit.
If a judge orders removal today it's almost certain they won't be deported today - an appeal will be filed placing a stay on removal. It is likely this hearing relates to a DHS motion to pretermit Liam's family's asylum application requesting they be removed to a country other than Ecuador.
There is pending litigation in the US District Court in DC that hopefully will result in a pause on the current practice by DHS of filing these motions. If the plaintiffs in that case can be certified as a class, it could pave the way for a nationwide injunction. That is what we are hoping for.
Unfortunately, appeals, at the 1st level, are heard by the Board of the Immigration Appeals which is essentially controlled by the Attorney General. However the goal is to get a circuit court of appeals, such as the ninth circuit to adjudicate the legality of these asylum cooperative agreements. /4
Attempts to argue an individuals will be harmed or persecuted in one of the third countries have largely been unsuccessful, especially because most individuals have never been to one of the third countries. Most attorneys are appealing orders granting pretermission and removal to third countries. /3
We are seeing these filed every day in Immigration Court for cases that are currently set out on the Court calendar to 2028 and 2029. The effect of these motions is to expedite the process resulting in the personβs claim of persecution in their country of nationality never being heard.οΏΌ/2

Yeah, Honduras has an annual cap of 400 or 450, so they may be maxed out. Not sure yet if Uganda has a cap but will figure that out soon.

Yeah, my office received several motions in the last few days, including one designating Uganda for a gay man from Ghana. This was done orally in court and I demanded a written motion which the judge granted.
