Constitutionally, the Congress gets to decide. Practically, if they decline to exercise their Article 1 authorities, they are complicit. The U.S. system is designed for civilian-on-civilian dispute over war powers, we ought not leave it to military lawyers.

Last year, as tourism grew worldwide, the U.S. was the only major destination to see a decline in foreign travelers. With increased scrutiny at the country's border, ICE violence and unpredictable policies, this year isnβt looking better.
