Interesting new paper on the false claims act. But I think it gets things precisely backwards. it assumes that nonintervene cases don't have value b/c they often result in no settlement. But that is expected given the stakes, incentives, and doctrine.

don't really understand this framing, which is so common. the idea that doctrinal courses don't equip you to "practice" makes no sense. there are lots of things you learn that you need to practice, even if they don't teach you how to respond to interrogatories.
