Wonderful news out of Oregon: the district court has enjoined DHS from continuing to tear gas our clients who live in an affordable housing development across the street from the Portland ICE facility!

This goes with something I’ve been thinking about: given that government officials can and do sue for defamation, is the FTCA’s prohibition on defamation cases against government officials constitutional as a matter of equal protection and due process?
Did it take a crazy hop at the lip of the dirt? Was it a seeing-eye single? A little dribbler that the third (circuit) baseman had to charge and fire to first off-balance? Or was it something else altogether, like maybe a question of statutory interpretation and not a lazy metaphor? We’ll never know
