Harper's response was that the "tradition" of having committees vet judicial applicants before their appointment, was not legally binding on him. It was merely a "tradition".
MORAL OF THE STORY: Such practices need to be written into legislation if we expect CONS to comply with them.

There are provincial committees of lawyers who vet applicants for judicial appointment, and provided a short list to the federal government.
Harper circumvented these committees by calling up party members who had not applied for appointment, or been vetted by members of the profession.
