To frame this as “free speech” ignores the harm caused and misinterprets the purpose of the First Amendment, which was designed to protect discourse, not acts of violence that silence and dehumanize others.
Additionally, this conduct undermines the rights of victims to bodily integrity and personal security—rights that are fundamental to any functioning democracy.
The Supreme Court has held that certain categories of speech, such as obscenity, true threats, & speech integral to criminal conduct, fall outside First Amendment protection. NDII falls squarely into these exceptions, as it is integrally linked to criminal conduct
Sharing intimate images without consent is inherently abusive and constitutes a form of sexual violence. It strips individuals of their autonomy, dignity, and privacy, causing profound psychological, emotional, and social harm.
The nonconsensual distribution of intimate images isnt protected speech under the First Amendment. Courts have consistently recognized that the right to free speech is not absolute & does not extend to speech that causes harm, violates privacy, or constitutes an act of violence
Devaluing the trauma and experience of other survivors does nothing to heal or validate your own experience. It only further harms the other. As a collective movement against sexual violence, in all forms, we need to recognize this & respect others- whether you can relate or not
