Civil Service model Policy Thank you for your letter of 17 November to Sir Chris Wormald, Cabinet Secretary, regarding the current Civil Service Gender Identity and Intersex model Policy (2019). I am responding on his behalf as Cabinet Office Permanent Secretary responsible for oversight of the work of the Office for Equality and Opportunity, and as the Chief Operating Oflficer of the Civil Service. We welcome the For Women Scotland UK Supreme Court ruling (SCR) and the clarity it brings for women and service providers. As a responsible employer, the Civil Service supports a culture where workplace relationships are built on respect, tolerance and inclusivity, where everyone feels safc. All Civil Service employment policies are developed, reviewed and appropriately updated to ensure that they follow the law. My team is currently reviewing the 2019 policy to ensure it remains legally compliant, aligns with the SCR and is informed by the upcoming revised EHRC Code of Practice (CoP) for services, public functions and associations. Although the CoP is not strictly applicable in a workplace context, it retains relevance as it covers the principles of equality, non-discrimination and reasonable adjustment. It is therefore important that we do not preempt the CoP, in determining the outcome of our review. The Cabinet Office will not be withdrawing the policy, or suggesting that departments should consider withdrawing theirs, until an updated version is finalised. The policy and guidance cover a number of aspects supporting transgender employees and their colleagues, and it will therefore remain in place to ensure departments have access to a model policy to help them understand how to fulfil their duties to all staff across all areas covered by the policy. The Cabinet Office is taking specialist legal advice where necessary and any revisions to the model policy and guidance w ill be made in accordance with such advice.
