Maybe less about misunderstanding — more so about agreement. It was barely enforced and probably ineffectual. It does raise a 1st amendment discussion. I'm of the mindset of expansion and enforcement leading to ethical journalism. That would look a lot different, but the baseline was there.

Ability, yes, but it is illegal without a warrant, and even so, that would be an incredibly difficult warrant to obtain unless they could show credible threat to an investigation or officers in doing so.
