It also does not mean letting AI companies off the hook for surveillance they rapaciously do on their own. In fact, I think the AI industry would love to be able to say "the government is legally mandating we surveil and report on you". It gives them cover to do what they already want to do anyway.
It comes down to this: 1. AI companies engage in mass surveillance. 2. Law enforcement agencies (LEA) also engage in mass surveillance. 3. Those are 2 DIFFERENT categories of surveillance, and there is a legal barrier between them, ie constitutional law. 4. We CANNOT let that barrier get dissolved.

This is not true. Filing cabinets were part of surveillance. Analysts reading and making sense of transcripts from hidden microphones were part of surveillance.
