Unfortunately for Plaintiff, its challenge fails because the White House office in question is not an "agency" under the APA and because Plaintiff did not bring the ultra vires claim necessary to challenge the President's statutory authority to complete his construction project with private funds and without congressional approval! 1 Case 1:25-cv-04316-RJL Document 47 Filed 02/26/26 Page 2 of 22 As such, unless and until Plaintiff amends its existing complaint to include the necessary ultra vires claim, the Court cannot address the merits of the novel and weighty issues raised by this statutory challenge, and Plaintiff's motion for a preliminary injunction must therefore be DENIED.
If Plaintiff is inclined to amend its complaint with the necessary ultra vires cause of action to test the President's statutory authority, the Court will expeditiously consider it and, if viable, address the merits of the novel and weighty issues presented. Until then, however, I have no choice but to deny Plaintiff's motion for a preliminary injunction for lack of likelihood of success on the merits. For all the reasons stated above, it is hereby ORDERED that the National Trust's Motion for a Preliminary Injunction [Dkt. #2] is DENIED. An Order consistent with the above will issue with this Memorandum Opinion. SO ORDERED. RICHARD J. LEON United States District Judge
NEW: Judge Leon denies the National Trust's preliminary injunction request in the White House East Wing/ballroom case, but basically begs the National Trust to amend its complaint to bring an ulta vires claim — alleging Trump acted without legal authority. storage.courtlistener.com/recap/gov.us...
CNN: Approval for President Trump's East Wing ballroom project – from a government commission that oversees planning for federal buildings and land in the nation's capital – is delayed after it received over 32,000 comments from the public overwhelmingly opposing the construction.
NOEM: I would disagree with the judge
CROCKETT: I'm sure you would, but can you tell me whether or not you have a law degree?
NOEM: A what?
CROCKETT: A law degree
NOEM: No I do no-
CROCKETT: Okay
A man with the government has been at the last two hearings relating to the contempt claim. Both times, he sat in the section of the courtroom open only to parties and counsel. Although not at counsel’s table, Littman and Jean Lin, the other Justice Department lawyer present at both hearings, has repeatedly consulted with him during both hearings. After today’s hearing — and after not being able to figure out for myself who he was after the last hearing — I asked him who he was. I had my press pass visibly displayed and identified myself as a reporter. He said he didn’t want to do that. I suggested that he must be a government official or employee, sitting where he was, and, if so, I asked incredulously if he really was not going to tell a reporter at a hearing who he was. He said no. Then, the people leaving — myself included — got to the elevator. Littman, Lin, mystery man, and two other people sitting with mystery man on the government side of the courtroom during the hearing on Wednesday were getting into the elevator. Some of them were already in the elevator. When I stepped in, mystery man said he would wait for the next elevator. Everyone else then got out of the elevator. Left in the elevator alone, I looked at these five adults — all of whom I believe have to be government employees, hence, paid by the public and allegedly working for the public — and was some combination of bemused and appalled. “You are all ridiculous,” I simply said. The door closed.
And, the story of the mystery man.

Tillis: You decided to kill that dog because you had not invested the appropriate time in training it, and then you have the audacity to say it’s a leadership lesson. You killed a goat and said it was behaving badly. You’re a farmer — you don’t castrate a goat, they behave badly.
When someone says „Scientists do not want you to know“ you can dismiss everything from there on. Scientists want you to know. They are desperate that you know. They can’t shut up about what they found out and want you to know.

The problem is detainees have different legal rights. Prisoners have more legal rights as detainees.
That’s why we don’t keep detainees on US soil in the past. Making them officially detainees in verbiage changes basic legal protections. They may as well be in Gitmo. I don’t think people get it.

Why Hazing Makes Better Men “Young men today are inundated with mixed signals, asked repeatedly to act against their instincts,” writes Catherine Morrissette. Last week, a series of police body-camera videos from a fraternity basement at the University of Iowa went viral. But the internet got it all wrong.
