If the Swiss government subpoenas a Swiss company about the business records they are legally required to keep (like payment info), there is nothing anyone can do to stop it. Privacy and anonymity are not the same thing, and the latter is impossible if you link stuff like a credit card.

The Swiss government subpoenaed them specifically to provide the credit card info used for the creation of the account. There is no legal way they could fight that. The privacy aspect of their offerings pertains to their data storage, platform logs, etc. It's a misleading headline at best.

Playing on a New3DS I didn't see any substantive performance issues with it. Same engine was used for ORAS without issue. From the tone I have a feeling that anything less than full agreement is going to become a prolonged argument. Either way I'm just gonna mute this and move on with my day.
