The move toward settlements and licensing agreements, distasteful as it no doubt seems to many artists, represents a safer path. And so long as artists can opt out of their work being included, the most obvious direct harm to individuals can be avoided. Still, you can probably imagine what lesson the tech industry will take from this development.
