I say SCOTUS came close, but didn’t overrule it bc Roberts saying of Korematsu that “has been overruled in the court of history, and—to be clear…”has no place in law under the Constitution,” is not the same as overruling it.

Strong words for sure.

The Bradwell case is also important because, besides saying women cannot practice law, it also was another example of economic rights not being protected even tho we have a constitutional right to life, liberty, and property.

You may like to know SCOTUS never overturned the Bradwell v. Illinois (1973) decision where they said gender was a disqualifying factor and so, women couldn’t practice law.

As for Buck v. Bell, SCOTUS never overturned it, but several states have done away with it or have implemented “strict” requirements.

Strict is used very loosely here.

Re: Korematsu (1944), the closest they got to overturning it was in Trump v. Hawaii (2018) when they said it had no place in the law.

Korematsu upheld Japanese internment saying it wasn’t race-based but was a military necessity.
