Let’s talk about Transformers! Or we could talk about law stuff, I guess. If you really want to.

A screenshot of page 28 of a legal document discussing the difficulty lower courts face when interpreting unclear or rapidly evolving guidance from the Supreme Court.

The following phrases and sentences are highlighted in yellow:

* "That said, the Supreme Court’s recent emergency docket rulings regarding grant terminations have not been models of clarity, and have left many issues unresolved."
* "California was a four-paragraph per curiam decision issued in the context of a stay application."
* "The outcome, which no party had requested, was, thus, inconsistent with the views of eight justices"
* "the issues are complex and evolving."
* "this Court, not the district courts or courts of appeals, will often still be the ultimate decisionmaker as to the interim legal status of major new federal statutes and executive actions."
* "...it is unhelpful and unnecessary to criticize district courts for “defy[ing]” the Supreme Court when they are working to find the right answer in a rapidly evolving doctrinal landscape, where they must grapple with both existing precedent and interim guidance from the Supreme Court that appears to set that precedent aside without much explanation or consensus."

It seems like federal district courts are in full revolt against SCOTUS. I've never seen such direct scathing criticism of SCOTUS like this from the bench over their shadow docket rulings quietly overturning precedent without explanation.

From the Harvard decision today.

Today, on a weekend with both kids away, Lori and I got up and did stuff. Woodland Art Fair, lunch at Sawyer’s downtown, and then finally visited the Lexington History Museum. 25 points for intentionality!

Now, naps.

Opinion | Whistleblowers Can Stop Illegal DEI The Justice Department expands its effort against discrimination by invoking the False Claims Act.

This is obvious BS (not only for the political reasons; it just ignores Escobar's materiality requirements). But perhaps this obvious BS will finally force the courts to put limits on an out-of-control relator's bar bringing meritless FCA cases.

The current budget bill is an atrocity and out-of-touch leaders like Chuck Schumer laid the groundwork by voting for the CR.

Appeasement and complicity do not work. When you bend the knee, they’ll break your leg.

Given the reality of the Trump admin tearing down agencies and structures that have been built over the last 70 years, where are the plans for how we’re actually going to build back better once adults get back in charge?

Screenshot from a misguided and pathetically hilarious WSJ editorial. Text reads: Mr. Trump might also think about whether he wants another Supreme Court appointment or two. Clarence Thomas is 76 and Samuel Alito turns 75 on April 1. Both will face a choice of whether to resign during the Trump Presidency or risk another election cycle.

Neither one is likely to resign if he lacks confidence in Mr. Trump’s judgment about who might be his successor. They have too much respect for the law, and the Court, to resign if they think Mr. Trump will nominate a results-first, law-second legal hack.

My party is embarrassing. We don’t need a “calvary.” We need a “cavalry.” It’s not just a typo in the email, it’s in the subject line too.

Unless you’re suggesting the party is going to sacrifice itself.

If I had a band or a label, I would do a punk cover of "No More Kings" from Schoolhouse Rock. And then I would gather a bunch of people to write a whole album of next-generation Schoolhouse Rock songs, with songs about Social Security and Medicaid and NOAA. I am not kidding in the least.

“The agreement we came to.”

Just two government officials publicly admitting that one sold out his constituents in exchange for not getting prosecuted for his corruption by the other’s colleagues.

*This* is why six DOJ lawyers have already resigned:

Dear Attorney General Bondi:
On February 10, 2025, I received a memorandum from acting Deputy Attorney General Emil Bove, directing me to dismiss the indictment against Mayor Eric Adams without prejudice, subject to certain conditions, which would require leave of court. I do not repeat here the evidence against Adams that proves beyond a reasonable doubt that he committed federal crimes; Mr. Bove rightly has never called into question that the case team conducted this investigation with integrity and that the charges against Adams are serious and supported by fact and law. Mr. Bove's memo, however, which directs me to dismiss an indictment returned by a duly constituted grand jury for reasons having nothing to do with the strength of the case, raises serious concerns that render the contemplated dismissal inconsistent with my ability and duty to prosecute federal crimes without fear or favor and to advance good-faith arguments before the courts.
When I took my oath of office three weeks ago, I vowed to well and faithfully discharge the duties of the office on which I was about to enter. In carrying out that responsibility, I am guided by, among other things, the Principles of Federal Prosecution set forth in the Justice Manual and your recent memoranda instructing attorneys for the Department of Justice to make only good-faith arguments and not to use the criminal enforcement authority of the United States to achieve political objectives or other improper aims. I am also guided by the values that have defined my over ten years of public service. You and I have yet to meet, let alone discuss this case. But as you may know, I clerked for the Honorable J. Harvie Wilkinson III on the U.S. Court of Appeals for the Fourth Circuit, and for Justice Antonin Scalia on the U.S. Supreme Court. Both men instilled in me a sense of duty to contribute to the public good and uphold the rule of law, and a commitment to reasoned and thorough analysis. I have always considered it my o…
