To close this gap, we recommend:
🔹 Strengthening collective action mechanisms
🔹 Properly resourcing enforcement authorities and building AI expertise
🔹 Introducing stronger procedural safeguards (including reversal of the burden of proof)
🔴 Our core finding: the AI Act alone cannot guarantee access to effective remedies.
Accountability requires more than compliance rules, it requires enforceable rights and accessible redress.
We look beyond the AI Act.
We analyse data protection, equality & non-discrimination, consumer protection and product liability law to assess whether they can fill existing gaps, and where structural weaknesses remain.
