From the post: “format-change from print library copies to digital library copies was transformative under fair use factor one” & therefore constituted fair use. It also ruled that using those digitized copies to train an AI model was a transformative use, again qualifying as fair use under US law.

Librarian here. Libraries, especially research libraries, buy books on the second hand market every day for the scenario you highlighted. I used to work at a large academic library and we actively bought used books for titles that were out of print so that our collection would be comprehensive.

I graduated high school in 1993 (👋 hello fellow olds). CNN was a constant on our HS tvs following the start of the Gulf War & the network’s wall-to-wall coverage. It was revolutionary.
I grew up thinking CNN = news 🗞️
