Man dies in police vehicle collision at Rundu A 43-year-old man died on Thursday after a police vehicle collided with his oxcart while attempting to cross the Rundu–Nkurenkuru road. According to Kavango East crime investigation coordinator deputy commissioner Bonifatius Kanyetu, the incident occurred on the road, opposite the Hilka Park residential area. A case of culpable homicide and reckless driving has been opened against the police officer involved in the crash, he says. It is alleged that the police vehicle was travelling from west to east when it struck the ox cart, which was crossing the road from south to north, around 19H30. The driver was identified as Ndara Kasera, from Satotwa village, along with two oxen. Both the oxcart and the police vehicle sustained significant damage in the accident. The police officer, who is the station commander at Ndama Police Station at Rundu, was also injured and is currently receiving treatment at the Rundu State Hospital. Kasera’s body was transported to the Rundu State Mortuary for a postmortem examination, and further investigations are underway. Bakkie kills boy (7) at Zambezi village A boy (7), who was fighting for his life at Katima Mulilo District Hospital after a bakkie ran him over at Singalamwe village, died on Tuesday night. The Grade 1 pupil from Sesheke Combined School in the Kongola area was crossing the road on Tuesday when the incident took place. Zambezi police traffic unit spokesperson sergeant Alex Mawaya says the boy was seriously injured during the accident on Kamega Road. “The information we got from our team is that it all happened fast and the boy suffered a head fracture in the process. The driver only realised he had run someone over later on,” he says. The driver has been arrested and faces charges of reckless and negligent driving and driving with an expired driving licence. The vehicle also had an expired licence disk. Mawaya earlier said if the boy died, an additional charge of culpable homicide would be added. Lüderitz man guilty over killing of brother A Lüderitz resident who killed his brother by stabbing him repeatedly with a knife has been found guilty of culpable homicide after standing trial in the Windhoek High Court. Brenton Hendricks (24) was found not guilty on a charge of murder, but convicted of culpable homicide, in a judgement delivered by judge Claudia Claasen on Friday. Claasen found that Hendricks was entitled to defend himself against an assault by his older brother, Joslin Hendricks (26), at their family home at Lüderitz on 25 September 2022, but that he exceeded the bounds of self-defence when he used a kitchen knife to stab his brother, with fatal results. Brenton told the judge during his trial that he was preparing an evening meal in his room when he heard voices outside and went to look what was going on. He took a knife, tucked under the waistband of his shorts, with him when he went outside. Brenton said he found his brother arguing with and swearing at their father. When he asked his brother why he was going on like that, Joslin grabbed him by his chest and neck, threw him to the ground and then punched him while kneeling on top of him, Brenton said. During the fight, he tried to get his brother off him, but Joslin also strangled him, and he then pulled out the knife and stabbed Joslin several times, he said. After Joslin had collapsed in their house, Brenton told their father that they had to rush him to a hospital. At the hospital, they were informed that Joslin had died. According to a post-mortem examination report, seven stab injuries were recorded on Joslin’s body. Some of the injuries were superficial, but two stab wounds to Joslin’s chest were fatal. Brenton used a kitchen knife with a 21-centimetre-long blade to stab his brother, Claasen noted in her judgement. “The evidence from both sides reveals that the deceased was the aggressor at the outset,” she said. “The court is satisfied that he [Brenton] was indeed attacked,” Claasen added. “All things considered […] I find that it was necessary to defend himself,” she said as well. However, the means used by Brenton, in the form of a knife with a blade 21 centimetres long, “was not reasonably necessary in the circumstances”, Claasen stated. The knife was “a formidable weapon”, and Brenton used it to stab his brother seven times, Claasen remarked. “That, in my view, is excessive in the circumstances,” she said. “He went overboard in his defence and ought reasonably to have foreseen that he might exceed the bounds of private defence. He was thus negligent in his actions.” Based on the finding of negligence, Claasen convicted Hendricks of culpable homicide. Hendricks was free on bail during his trial, but his bail was cancelled after the delivery of the verdict. He has to return to court on 19 June for a presentence hearing. NamPower manager in court on culpable homicide charge A Nampower technical support manager who was involved in a car accident earlier this year that resulted in the death of Pauline Indipo (28) made his first court appearance in the Windhoek Magistrate’s Court on Friday. David Mbidi appeared before magistrate Mutafela Muharukua on charges of culpable homicide, and reckless and negligent driving. State prosecutor Menencia Hinda proposed that the court be remanded to 23 July for further investigation and for Mbidi to obtain legal representation. The accused said he was yet to obtain legal representation after LegalWise informed him the lawyer ‘M Malumbano’ was not contracted to them. “. . . and I will receive a new lawyer,” he said. Mbidi’s bail has been extended to 23 July, and he has been warned not to leave town without informing the police. According to police reports, the accident took place on 7 February when Mbidi’s car hit the sedan in which Indipo was travelling from behind at full speed, which also resulted in the sedan’s driver sustaining serious injuries. “The driver was rushed to Katutura State Hospital after sustaining serious injuries, and has been battling for his life in the intensive care unit,” the police say. Reports from officials who attended the accident scene alleged that when questioned, Mbidi said the driver of his car fled the scene and was also unknown to him. He claimed he had no personal details of the driver who was only instructed to drive him to his house in Hochland Park. DEFEATING THE COURSE OF JUSTICE However, Indipo’s family allegedly believed conspiracy between the suspect and Ulenga covered up the incident. Mbidi was only arrested three days after he handed himself over to the police for procedural reasons to appear in court. An Indipo family spokesperson, who wished to remain anonymous, yesterday told The Namibian they were informed by Ulenga that he was advised by the Windhoek City Police at the scene not to carry out an alcohol and drug test on Mbidi. “There is no indication in the docket that Mbidi lied to the police officer,” the spokesperson said. The family says 92 days have passed since the accident and no progress has been made to obtain statements from witnesses or a reading from the vehicle’s speedometer. The family wants to know why a charge of defeating the course of justice was not brought against Mbidi after the initial police report indicated he had no recollection of the driver’s whereabouts. “All this critical information is missing from the docket that is in the hands of the prosecutor and this is a great concern to us, as a family,” he said. The family has taken the matter to detective inspector Raymond Kuiseb, who undertook to reconstruct the details of the accident scene. NO BREATHALYZER Court documents show that no breathalyser test was conducted on Mbidi, despite the fact that he was the only occupant of the vehicle. Kuiseb told Indipo’s family he was not happy with how the police handled the incident. “I need to be briefed on every serious incident,” he said. He said it is presumed by law that the person found in the vehicle is the driver until the contrary is proven. Truck claims life of man in Zambezi The Namibian Police in the Zambezi Region have registered a case of culpable homicide or negligent driving after the driver of a truck allegedly struck a pedestrian along the Trans-Caprivi Highway on Friday. The pedestrian, who died on the spot, has been identified as Oscar Sitali and his next of kin have been informed. According to Zambezi police spokesperson and head of community policing Kisco Sitali, the incident took place around 18h30 on Friday in the Liyamukulo area of Kongola. “The driver was heading from the western to eastern direction along the Trans-Caprivi Highway and upon approaching Liyamukulo, the pedestrian who was alone was crossing the road from north to south. The driver was sober as per the breathalyser tests done by traffic officers and he has a valid driver’s licence,” noted Sitali. Sitali added that information obtained indicated that the victim was running and was spotted at close range by the driver who tried to avoid the accident by swerving to the south. The pedestrian ran in the same direction and was hit. “There are visible brake marks at the scene and the driver was alone with no passengers. The driver heard something hit on his truck and he stopped the truck almost 100 metres from the scene. The deceased sustained serious multiple injuries,” stated Sitali. The deceased was a resident of Sikaunga village, and his body was transported to the state mortuary for an autopsy to be conducted to determine the exact cause of death. Woman dies after being hit by taxi at Opuwo A CULPABLE homicide case has been opened at the Opuwo Police Station after a woman died after she was allegedly struck by a taxi at the town on Sunday evening. Chief inspector Vehangaiza Ruiter, the Namibian Police’s community affairs officer for the Kunene region, said on Monday that the incident occurred at around 20h00, when a woman, believed to be in her late thirties, was allegedly hit and killed by an oncoming vehicle while attempting to cross the road at Orutjandja location at Opuwo. “A taxi was traveling from the Ondororundu area when the driver collided with the woman, who was crossing the road, resulting in her death at the scene. The taxi driver remained at the scene and contacted the police, who arrived to initiate an investigation,” Ruiter said. She added that the deceased’s next of kin have not yet been notified, as police are still attempting to establish the family’s whereabouts given that no identification documents were found with the deceased. In an unrelated incident at Opuwo, an Angolan national, identified as Kauendera Ruvandu, allegedly drowned around 18h20 on Sunday while trying to cross a river during heavy rainfall at Orutjandja location. Ruiter said the deceased allegedly attempted to cross the river despite several onlookers warning and trying to dissuade him.
